Car Accident Claims

Car crash personal injury claims are the most common type of injury claim and the largest proportion of compensation paid out every year is paid to those persons injured in car accidents.

The largest number of injury claims with the Injuries Board are claims for compensation by those who have been injured in car accidents. If you have been involved in a car crash that was not your fault, you may be entitled to take a claim for compensation for your injuries as well as any expenses that you may have incurred or any income that you may have lost as a result of the car accident.

If you have been involved in a road traffic accident, get in touch with an experienced personal injury solicitor for a claim assessment. Sinnott Personal Injury Solicitors have an experienced team who can help with any personal injury case and have offices in Dublin and Cork.

In addition to any claim that you may have for your physical injuries arising from the car accident, you may also have sustained psychological injuries.

Often our clients present with various psychological injuries after a car accident and it becomes necessary to claim compensation for their psychological injuries as well as the physical injuries sustained.

Symptoms typically include nightmares, sleeplessness, post traumatic stress, nervousness, an inability to carry out tasks that were previously not a problem.  There are a range of other psychological symptoms which give rise to psychological injuries in connection with car accident compensation claims and your Solicitor will discuss those with you.

In addition to obtaining a medical report from your treating Doctor or Orthopaedic Surgeon it may also be necessary to obtain a Psychiatrist’s report in relation to any psychological injuries that you may have sustained as a result of the car accident.

It is important to claim compensation for the following:

  • Compensation for material damage to the vehicle (if applicable)
  • Compensation for out of pocket expenditure in connection with the car accident claim such as medical receipts, loss of income and other out of pocket expenditure
  • Compensation for physical injuries sustained as a result of the car accident
  • Compensation for psychological or psychiatric injuries sustained as a result of a car accident

Case Study: Michael’s claim – Whiplash and psychological injuries

Michael was driving a car with a 1.4 litre capacity when he was rear-ended by a four-wheel drive which was travelling at considerable speed and unable to stop at the traffic lights.

Michael sustained injuries to his back, severe whiplash and psychological injuries as a result of the car accident. Michael claimed compensation for his injuries arising from the car accident and he rejected the Injuries Board Assessment which Sinnott Solicitors Dublin and Cork considered did not adequately compensate Michael for his injuries.

Ultimately Michael’s case settled, and Michael achieved compensation for his injuries arising from the car accident claim in the sum of €67,750 together with his out of pocket expenditure, loss of income and his legal fees were paid by the Defendant’s insurers.
